Small Claims Court

Small Claims Court in Ontario is a legal forum for resolving disputes involving amounts up to $50,000. It provides an accessible way for individuals and businesses to recover money owed, address contract issues, or resolve property and consumer disputes without the complexity of higher courts.

At KDLS, I provide full support throughout the Small Claims Court process. This includes preparing and filing claims, developing a legal strategy, representing you in court, and negotiating on your behalf. Whether you are pursuing a claim, defending one, or enforcing a judgment, you receive professional advocacy and guidance every step of the way.

Common types of claims include: unpaid invoices and debts, contract breaches, property damage, consumer complaints, employment disputes, landlord/tenant issues outside the Landlord and Tenant Board, and judgment enforcement.

Before taking a matter to court, I can also draft demand letters or cease and desist letters to help resolve disputes quickly and efficiently, often avoiding the need for formal litigation.

Demand Letters

A demand letter is a formal written notice outlining a grievance, the remedy sought, and a specific timeframe for resolution. While not legally required in Ontario before initiating most civil claims, a well-drafted demand letter demonstrates good faith, establishes a clear record, and provides an opportunity to resolve disputes without going to court.

Demand letters can be used in a variety of situations, including unpaid work or services, breach of contract, or workplace disputes such as wrongful termination or discrimination. They clearly communicate the claimant’s position, request fair compensation, and often prompt the other party to act promptly.

Having a licensed paralegal draft your demand letter ensures it is professional, accurate, and persuasive. The letter will outline the facts, legal basis, and requested resolution, maintain a neutral tone, and adhere to Ontario legal standards. A well-prepared demand letter not only encourages settlement, but also creates a paper trail that can strengthen your case if litigation becomes necessary.

Using a demand letter is a cost-effective and strategic step in dispute resolution—helping you assert your rights while potentially avoiding time-consuming and costly court proceedings.

Cease and Desist Letters

Cease and Desist Letters help resolve disputes efficiently and protect your legal rights. These letters are often the first step in addressing issues before they escalate to arbitration, mediation, or litigation.

Cease and Desist Letters are commonly used in situations such as:

  • Intellectual Property Infringement: Unauthorized use of trademarks, copyrights, or patents
  • Defamation: False statements harming your personal or business reputation
  • Harassment: Stalking, cyberbullying, or other unwanted contact
  • Breach of Contract or Confidentiality
  • Unfair Competition or Passing Off: Misrepresenting goods, services, or engaging in false advertising

An effective Cease and Desist Letter includes:

  • Identification of the parties involved
  • Description of the alleged wrongdoing, with supporting evidence
  • Legal basis for the claim
  • A clear demand to stop the activity
  • A deadline for compliance
  • Potential consequences if the activity continues, including the possibility of legal action

While a Cease and Desist Letter is not legally binding, it serves as a formal notice that legal action may follow and can often resolve disputes in a cost-effective and timely manner.

Landlord Tenant Board

Tribunal:

The Landlord and Tenant Board (LTB) London is Ontario’s tribunal for resolving disputes between landlords and tenants under the Residential Tenancies Act. It handles issues such as eviction proceedings, unpaid rent, maintenance concerns, and other tenancy matters.

KDLS provides guidance throughout the LTB process, including preparing and filing applications, organizing evidence, and representing clients at hearings. Whether assisting landlords in enforcing lease agreements or tenants in protecting their legal rights, KDLS helps navigate the procedural requirements and ensures cases are presented in accordance with the law.

Lease Drafting:

KDLS provides professional lease drafting services for landlords and tenants across Ontario. Whether for a new residential lease or a customized commercial agreement, each contract is clear, enforceable, and fully compliant with the Residential Tenancies Act, 2006.

Key terms such as rent, deposits, maintenance obligations, utilities, and additional clauses are carefully structured to protect rights and reduce the risk of future disputes. For residential tenancies, the mandatory Ontario Standard Lease Form is properly used, and any unlawful or unenforceable provisions are removed.
